Statutory Rape Sentence Stands

SANDPOINT, Idaho (AP) The Idaho Court of Appeals has rejected a request by a northern Idaho man for a re-sentencing hearing following his guilty plea to statutory rape.
The Bonner County Daily Bee reports (http://bit.ly/10tF02p) the court on Monday upheld a 1st District Court decision involving the 2- to 8-year sentence given to Scott Anthony Hansen.
Hansen contended an error by the district court in not allowing him to make a statement before sentencing required a re-sentencing hearing. Hansen also argued the district judge erred in relinquishing jurisdiction, negating Hansen's chance at being paroled after a year in jail.
The appeals court ruled the district court's error didn't necessarily equate to a deprivation of a constitutional right.
The court also noted that Hansen had numerous disciplinary problems in prison, making him a poor candidate for early release.
