Representatives of the former Big East Conference have informed Boise State they plan to sue the university for $5 million dollars.
They say that's the penalty for BSU dropping out of the conference.
Boise State is responding with a lawsuit asking the court to declare that no such penalty is due.
BSU officials claim the new conference is vastly different to the one they agreed to join.
The Big East no longer sponsors college football and will soon be the Amerian Athletic Conference.
President Bob Kustra said "BSU entered into a agreement in good faith and with a great degree of optimism, but the conference we agreed to join simply no longer exists."
